| Zusammenfassung: | The article 65 of the Ley Orgánica de Educación Intercultural (Intercultural Education Law), until April 2021, established a special sanctioning administrative procedure for teachers of the National Teachers Forum of Ecuador, which contemplated the possibility to appeal the decisions made by the Juntas Distritales de Resolución de Conflictos (Conflict Resolution District Boards); this gives an end to the administrative phase and recognized the right to appeal to the Tribunales Contencioso Administrativos (Admnistrative Courts of Justice). The aforementioned rule excludes the right to file an extraordinary appeal. On the one hand, in this article —through a case study— will be analyzed whether or not this legal regulation becomes a limitation to the right to appeal that Ecuadorian Teachers used to have the right; on the other hand, it will be determined whether or not the Ecuadorian regulations comply with the international and constitutional standards that recognized this right. |
