Derecho a la identidad frente a la negativa administrativa en la rectificación de datos de filiación.

This case analysis examines the effects of the refusal of rectification of affiliation data by the Zonal Coordination 1 of the General Directorate of Civil Registry, Identification and Certification, in the case of Mr. Nelson Joffre Crespo Almeida in relation to the violation of the right of identity, in which the person responsible for issuing the resolution did not exercise his position in accordance with the competences and powers attributed to him by the Constitution and the law; without any causal cause, the renewal and obtaining of the Identity Card is denied due to the Administrative Refusal, leaving the applicant's identification document without effect. The interpretation of the legal regulations by the public servant of the Civil Registry at the time of issuing the refusal resolution, to renew and obtain the unique identity document, violates the law and constitutional guarantees.
