| description | This case analysis examines the effects of the refusal of rectification of affiliation data by the Zonal Coordination 1 of the General Directorate of Civil Registry, Identification and Certification, in the case of Mr. Nelson Joffre Crespo Almeida in relation to the violation of the right of identity, in which the person responsible for issuing the resolution did not exercise his position in accordance with the competences and powers attributed to him by the Constitution and the law; without any causal cause, the renewal and obtaining of the Identity Card is denied due to the Administrative Refusal, leaving the applicant's identification document without effect. The interpretation of the legal regulations by the public servant of the Civil Registry at the time of issuing the refusal resolution, to renew and obtain the unique identity document, violates the law and constitutional guarantees. |

The interpretation of the legal regulations by the public servant of the Civil Registry at the time of issuing the refusal resolution, to renew and obtain the unique identity document, violates the law and constitutional guarantees.El presente análisis de caso examina los efectos de la negativa de rectificación de datos de filiación por la Coordinación Zonal 1 de la Dirección General de Registro Civil, Identificación y Cedulación, en el caso del Sr. Nelson Joffre Crespo Almeida en relación a la vulneración del derecho de identidad, en el cual, el responsable de emitir la resolución, no ejerció su cargo conforme a las competencias y facultades que le son atribuidas por la Constitución y la ley; sin existir causal alguna, se niega la renovación y obtención de la Cédula de Identidad por causa de la Negativa Administrativa dejando sin efecto el documento de identificación del solicitante.
