| Резюме: | Civil marriage is a voluntary legal act that emanates from the consent of the parties. Given this, it has been proposed through the study of this article, to analyze the benefits and limitations offered to the family by the celebration of civil marriage by notarial office. The notary public has the legal capacity to provide legal security to non-contentious acts and contracts that citizens require. In this way, the notarial law contemplates the power to intervene in acts referring to the civil status of people, therefore, based on this argument, it is feasible to expand the notarial powers and grant alternatives to the citizen aimed at protecting the right to the family and guarantee the autonomy in the will of the parties. Indeed, cumbersome procedures were identified for the spouses who wish to get married and the need to decongest the public administration regarding acts of voluntary jurisdiction was verified. In this sense, the present investigation is configured in an expeditious alternative that grants the possibility of choosing different officials endowed with public faith. To comply with the study, the methodology was used through the historical method; taking into account the background and regulations that regulate marriage, in relation to the needs of today's society. In the same way the synthetic analytical method; inasmuch as it allows us to choose between the functions of the notary and civil registry officer. Indeed, the research is carried out with an exploratory level of depth. The main results of the work make it possible to affirm that the celebration of civil marriage in notarial offices in Ecuador constitutes a viable alternative that could offer various benefits to citizens. With it, it is not intended to replace the role of the Civil Registry, but to complement it, improving the satisfaction of the population, the quality of the service and the reduction of time. |
