Resumo:The present study aims to meet a small but very important part of the second book of the comprehensive criminal organic code (COIP), where refers to the direct procedure. This study comes from the juridical normative perspective, directly concate-nated with the neo Constitutionalist approach as a guarantee for the principles of due process that are systematized in the Constitution of the Republic, as well as internation-al human rights conventions and treaties. In this sense, from the axiological and teleo-logical view of the law, can determine quantitatively and qualitatively, if with the appli-cation of the direct procedure in the inter-institution Unit of Penal guarantees with com-petition in flagrant violations from Quito district, beginning from the entry into force of the COIP, it violates or not the right to equality and due defense.
