| Čoahkkáigeassu: | This research addresses the dynamics of the end of labor relations in Ecuador, specifically of the 'Visto Bueno', focusing on its administrative nature and the possibility of resorting to the courts. It analyzes and identifies inconsistencies in the regulation of the 'Visto Bueno' in article 172, numeral 3, of the Labor Code, since the determination of immoral conduct is not clear. It is also found that the term to answer the request for approval is short, which often makes it difficult to obtain evidence in defense, violating the right to legitimate defense. For these reasons, it is considered pertinent to analyze and determine whether the 'Visto Bueno' in Ecuador is an effective procedure, through the analysis of the national legislation and the description of the causes and consequences that may provide for its application. In order to determine these factors, it is necessary to carry out an exhaustive documentary review in relation to this procedure, as well as the use of the qualitative method through the application of interviews directed to professionals in the area, which allows to know the process in more depth through experience, opinion, perception and personal knowledge. As a conclusion of the study, it is established that the 'Visto Bueno' is not effective, since it is found that the provisions of the Labor Code can be ambiguous and difficult to apply in practice. On the other hand, although it is recognized that the effectiveness of the 'Visto Bueno' depends to a large extent on the impartiality and social commitment of the competent authority. |
