| Résumé: | This research work focused about children of mothers deprived of liberty in the “Pichincha 3', Penitentiary Center, with special attention to the protection of their fundamental rights, especially in health and food. The central objective was to analyze the legal framework that supports the protection of these children in a prison environment. The methodology used consisted of a mixed approach that included documentary review, interviews with prison staff and surveys of 36 mothers with children in prison. The results highlight gaps in the care of basic needs for 29 children, pointing out deficiencies in access to health and food services. Factors such as the lack of adequate conditions for the comprehensive development of the child, a shortage of specialized medical personnel and deficiencies in the provision of nutritious food contribute to this problem. The prevalence of the best interests of the child is not evident, and it is determined that the guarantee of rights of access to health and food is partially fulfilled. The analysis of the case highlights the urgent need to address these shortcomings to ensure the well being of children in vulnerable situations, seeking to contribute to the comprehensive protection of their rights in the prison context. |
