| description | The Joint Comprehensive Plan of Action is a legal instrument signed on June 2015 that allows international monitoring to all uranium enrichment plants in Iranian territory in exchange of lifting the sanctions imposed to the development of the Iranian nuclear program. By studying the document itself and the foreign policy of Iran and The United States, this dissertation aims to analyze the influence of American foreign policy in the signing of the Joint Comprehensive Plan Of Action (JCPOA) to remain a hegemon over Iran in nuclear issues. In order to verify that the modification of the American foreign policy in nuclear issues towards Iran, would have been caused by the preponderant role of the United States in the international community and the Iranian need to end the sanctions, which would be evidenced by the signing of Joint Comprehensive Plan of Action (JCPOA) that maintains the current hegemonic system, this dissertation will use a neorealist also referred as structural neorealism as theoretical framework. Additionally, a qualitative methodology through an inductive approach will be used to develop this dissertation. After determining the motivations of the United States to change the strategy of sanctions and start negotiating with Iran and identifying the reasons why Iran decided to negotiate the limits of its nuclear program with the United States, this dissertation recognizes the elements within the JCPOA that show evidence of a hegemonic dynamic. Finally, this dissertation concludes that international law instruments are a reproduction of the underlying power distribution of the system and therefore the JCPOA does represent a mechanism of American hegemony over Iran. |
