總結:Surrogacy is an assisted human motherhood technique used by thousands of people around the world to fulfill their desires to expand their family. Thus, many countries have opted for the favorable implementation of this technique in legislation, with the intention to establish parameters, requirements, rights and duties of those involved, in order to guarantee that this technique is beneficial and contributes positively to the lives of the people who have chosen to use it. The importance of this research lies in analyzing surrogacy as an assisted human maternity technique aimed at guaranteeing the right to reproductive health. The general objective of this research was to identify the protected rights of children from conception for surrogacy, through the review of national and international regulations, analysis of sentences and direct observation, in order to determine their legal applicability in the equator. The research used a qualitative approach, together with the anthropo-legal and analytical method, while the techniques used were documentary review, direct observation and review of sentences. Through doctrine, criteria issued by international organizations, international legislation and sentences from different human rights protection systems regarding the regulation of surrogacy, the research resulted in the compilation of those rights that are guaranteed to boys and girls. since conception, both in Ecuador and internationally. The conclusion obtained was that, at a global level, the protection of the Best Interest of the Child is sought and decision-making is exercised based on the protection of their rights.
