Резюме:Forced disappearance, a phenomenon that has left its mark in the majority of countries worldwide, holds particular significance in Ecuador due to its capacity to violate fundamental human rights and undermine democratic principles, that is why the study of this issue aims to identify the reasons behind the classification of forced disappearance as a crime in Ecuador, this will be achieved through interviews and case analyses with the overarching goal of identifying the rights violated when judging and providing comprehensive reparations to the victims, the focus is on the case of the 'Hermanos Restrepo.” the methodology employed in this research is based on a qualitative approach with a descriptive depth, utilizing research methods such as legal-historical, inductive, and historical-anthropological approaches, research techniques include interviews and thorough documentary reviews, facilitating an analysis of the perspectives of those close to this criminal type from a deep and real-case-based standpoint, regarding the most notable results of the investigation, it is highlighted that after careful examination of the 'Hermanos Restrepo' case, its reference value in crimes against humanity was underscored, additionally, a significant outcome was the analysis of the concept of forced disappearance at both national and international levels, exploring its scope, lastly, a diagnosis was reached concerning comprehensive reparation in the 'Hermanos Restrepo' case, identifying deficiencies in the justice system, with a particular emphasis on comprehensive reparations for the victims, this work significantly contributes to a profound understanding of forced disappearance and its legal implications, fostering critical reflection on justice and human rights in the Ecuadorian context.
