Shrnutí:Freedom of expression is a fundamental right of every person, as is the right to freedom of thought, opinion, and sound criticism. The legal framework that supports this right is not entirely well regulated, and there are many loopholes. Although the Constitution guarantees this right, its exercise is limited by ambiguous or poorly structured regulations, leading to the dissemination of false information with impunity and damage to the reputation of individuals and public entities. The 2013 Organic Law on Communication is considered outdated and lacking legal loopholes that can lead to self-censorship. The need to balance freedom of expression with the safeguarding of information and the prevention of disinformation in digital media, pursuing the ethical and responsible use of digital media, freedom of expression, and digital media, analyzing historical precedents and their progress in Ecuador, is addressed. The challenges of regulating content on social media, the uncertainty of the LOC (Organic Law of Communication), and the effect of anonymity on the dissemination of data are addressed. Significant revisions to the Constitution and the LOC are presented, along with international human rights legislation. It is clear that the lack of specific and updated regulations for digital media impacts authentic information and facilitates violations of freedom of expression. A balanced regulatory framework is needed to ensure freedom of expression and a sound legal basis for ensuring data protection.
