| Crynodeb: | This research analyzes family mediation as an alternative to litigation in Ecuador, emphasizing its relevance in resolving conflicts within the legal and social spheres. A mixed methodology—both qualitative and quantitative—was adopted, allowing for the collection of empirical data through surveys administered to 100 citizens in Guayaquil and interviews with professionals in the field. The findings reveal a low level of public awareness regarding family mediation, despite its legal recognition and constitutional support. The analysis shows that a significant portion of the population is unaware of the benefits, accessibility, and even the free nature of the service. Nevertheless, there is a positive perception of its use, as 73% of respondents expressed willingness to attend a mediation center before initiating a family court process. Interviews highlighted key benefits of mediation, including speed, lower costs, flexibility, and reduced emotional strain, both for the individuals involved and the judicial system. The study concludes that, although family mediation has a strong legal framework and offers clear advantages, its limited public outreach and territorial coverage hinder its effective implementation. It is recommended to strengthen training programs, launch awareness campaigns, expand both physical and digital access, and integrate technological tools to improve its reach—especially in rural and vulnerable areas. These measures would help foster a culture of peaceful resolution of family conflicts throughout the country. |
