| Резюме: | Digital pollution is a little studied phenomenon, it is born with the advancement of technology and branches into two classes, on the one hand, the pollution produced by solid waste or electronic waste and on the other hand the pollution product of excessive, irrational and irresponsible of the internet, to the latter, several researchers call it in the strict sense with digital pollution, the subject of study contemplates a legal perspective in which it involves aspects such as ecocentrism and the protection that nature receives as a subject of law; the Ius Positivum is activated from the axioms of environmental law, such as precaution, environmental education, among others. The regulatory framework is aimed at evidencing the most relevant aspects around the problem of study, which includes the current regulatory legal framework of ICT public policies due to the apparent affectation that it produces in the use of digital tools, evidencing the lack of jurisprudence which irrefutably suggests that it is a type of invisible contamination imperceptible to the human eye. The application of the research methodology of this exploratory project has allowed to collect the opinion of the main Latin American referents who have studied digital contamination as a theoretically new phenomenon, likewise, surveys have been carried out on university teachers to know the behavior and treatment regarding the responsible use of digital tools. Digital pollution exists and must be addressed in a multidisciplinary way in order to know the consequences on human health and the habitable environment in the future. |
