It was identified as the main problem the inadequate application of sanctions in the youth penal system, which, despite its restorative approach, fails to provide effective answers against crimes. This situation generates a worrying scenario in which teenagers are constantly recruited in criminal groups because of their perception of impunity and low severity on the sanctions they face. The objective is to analyze the regulatory framework and the juvenile penal responsibility, proposing improvements that guarantee an effective rehabilitation without unknowing the rights of minors. The study justifies the urgent need of checking the youth penal system effectibility giving the increase of minors involved in criminal bands. In addition, it seeks to balance the guarantor approach with the public security and the repair of the damage caused........ |
