Sumario: | This work addresses the issue regarding the guarantee of fundamental rights stemming from the existence of a constitutional State. To this end, it reviews the characteristics that a constitution and a State model must meet to be considered as such. In light of this, it analyzes the technical mechanisms available to the state institutions to fulfill these obligations and meet the needs resulting from the recognition of fundamental rights. Likewise, it examines the structure of guarantees established in the current Ecuadorian Constitution, emphasizing the guarantee of public policies. |
