Para esto, se da un repaso a las características que debe cumplir una Constitución y un modelo de Estado para ser considerado como tal. En virtud de aquello, se analiza los mecanismos técnicos con que cuenta la institucionalidad estatal para cumplir con esas obligaciones y satisfacer las necesidades resultantes del reconocimiento de derechos fundamentales.
