Estas exigencias, señala, van más allá de la normatividad sobre propiedad intelectual ya que los países andinos cuentan con este tipo de normas, altamente funcionales a los intereses de las transnacionales farmacéuticas. Cuatro son los ámbitos en los que se ubican las exigencias norteamericanas en la materia: protección con derecho de exclusividad a la información no divulgada; condicionamiento al ejercicio de las licencias obligatorias; ampliación del tiempo de protección a las patentes y los segundos usos; y eliminación de las exclusiones a la patentabilidad.
