Summary:The traditional logic of studying and understanding the Andean integration process from the economic, political and social level, without skimping on the functioning, evolution, impact and contribution of the organs and institutions of the Andean Integration System in the evolution of the Andean Community, should start to be discarded. These are who really design, guide, regulate and even ensure the motion and the impulse of this process, also known as the Andean process. From there arises the interest for investigating one of them, whose existence is legally necessary to accomplish the objectives and purposes of this process, and we refer to the Andean Court of Justice. Being this fundamental piece in the supranationality of the Andean process, and whose main mandate is to guarantee the legality and the application of the Subregional Integration Agreement, in this investigation we consider that this Community body makes the difference between the Andean process and the European. Therefore, in this article we maintain, as few authors have estimated, that the main effect of the Court's work in the progressive construction of the Andean integration process is to have provided an identity to the Andean process, allowing it to be configured as a unique process.
