Tilføj Tag | Summary: | Toe present paper analizes the development of the Consejo de la Judicatura in Ecuador, since its establishment as part of the judicial branch in 1993 to our days. lt pretends to show the historie references that made possible its creation in diverse European and American countries, becoming an antecedent for its origin in our country. The Consejo de la Judicatura intended to improve the judicial's branch independence, allowing the understanding that the separation of powers is a main principie of the Rule of Law. Next, the Consejo de la Judicatura's structure and funclíons will be studied, as well as the events that occurred since its origin from 1998 to 2008, when the Constitution changad the judicial's branch structure, making possible the establishment of a brand new Consejo de la Judicatura. After the 2011 referendum, il was decided to make it "transitory", bringing severa! structural changes and giving way to the conformatlon of the present Consejo de la Judicatura, which now has new functions and a new organization. |
