Gaia:This article aims to determine when the crime of incompatible negotiation —regulated within Title XVIII, in article 399 of the Penal Code— is consummated from a study of the dogmatics of dangerous crimes. Subsequently, it will be analyzed whether the jurisprudence of the Supreme Court of Justice of Peru is correctly interpreting the moment of consummation of this crime that seeks to punish «the official or public servant who, improperly, directly or indirectly or through a simulated act, he is interested, for his own benefit or that of a third party, in any contract or operation in which he intervenes by reason of his position».
