| description | This article its main purpose is to show a historical, theoretical and comparative journey of patriarchy, the use of law as a tool to strengthen it and the struggle of women in the socio-juridical field to reinvindicate their bodies as political territory of autonomous decisions and not dominated. The present investigation is des-criptive and makes use of the qualitative approach and the legal dogmatic way. As a main conclusion, it is determined that despite the social struggles carried out in favor of women's rights, patriarchy does not allow the full reinvindication of wo-men as a full subject of rights, especially a limitation in the exercise of reproducti-ve rights and sexual. The scope of this work excludes the quantitative approach gi-ven that there is difficulty in accessing reliable statistical data from a public health entity in Ecuador. |

The scope of this work excludes the quantitative approach gi-ven that there is difficulty in accessing reliable statistical data from a public health entity in Ecuador.El presente artículo muestra un recorrido histórico, teórico y comparado del patriarcado, el uso del derecho como herramienta de fortalecimiento del mismo y la lucha de las mujeres en el campo sociojurídico para reivindicar su cuerpo como territorio político de decisiones autónomas y no dominadas. La presente investigación es descriptiva y hace uso exclusivo del enfoque cualitativo y del modo normativo jurídico y sociológico jurídico. Como conclusión principal se determina que, a pesar de las luchas sociales realizadas en favor de los derechos de las mujeres, el patriarcado no permite reivindicar plenamente a la mujer como sujeto pleno de derechos; en especial se verifica una limitación en el ejercicio de los derechos reproductivos y sexuales. El alcance del presente trabajo excluye el enfoque cuantitativo, dado que existe dificultad en el acceso a datos estadísticos confiables de una entidad de salud pública en Ecuador.
