Two contrasting positions are being considered in jurisprudence. The objective is to resolve that, when faced with a similar legal issue, two different alternatives are being decided upon, both of which affect the right to liberty and consequently, the various consequences of incarceration. Thus, we will begin by emphasizing the importance of liberty as a fundamental prerequisite, followed by the identifcation of the two opposing positions regarding the same situation, and subsequently, the signifcance of the role of the argumentative judge will be addressed. Utilizing a qualitative methodology, which involves studying the topic through jurisprudence, doctrine, and literature, it will be inferred that limitations on the right to liberty within a contested procedural scenario may stem from various evaluative positions, and therefore, only a plausible result derived from the guarantee of motivation is foreseeable.

Indispensable es tratar temas procesales respecto a la privación de la libertad, presentándose en la actualidad una discusión latente en Colombia, en la que se valora argumentativamente si se debe restringir para una persona este derecho, una vez se ha dictado el sentido del fallo condenatorio cuando existan prohibiciones respecto a beneficios punitivos, denotándose dos posturas de la jurisprudencia que se contraponen. El objetivo perseguido es resolver que frente a un problema jurídico similar se viene decidiendo con dos alternativas distintas que comprometen el derecho a la libertad y, con ello, el despliegue de las múltiples consecuencias del encierro. Así, se iniciará fijando la categoría de la libertad como un presupuesto máximo; enseguida se ubicarán las dos posiciones contrapuestas frente a una misma situación y, a partir de ello, se vinculará al trabajo la trascendencia del rol del juez argumentador.
