Valor jurídico del preámbulo de la Constitución ecuatoriana vigente

Se analiza aquí el preámbulo de la Constitución ecuatoriana desde varias perspectivas. Inicia con un estudio abstracto sobre la naturaleza y funciones más importantes de los preámbulos, como la función relacionada con la interpretación de la misma Constitución y de otras normas del ordenamiento jurídico (Cap. I). Luego se revisan los contenidos que los preámbulos constitucionales suelen tener, en Ecuador y en el mundo, como la cuestión del fundamento de la misma norma suprema y el nombre con que se designará (Cap. II). Con estos antecedentes, se analiza el sentido específico de los diversos incisos que conforman el Preámbulo de la Constitución de 2008, dando especial importancia a los que mencionan los fines constitucionales y el nombre de Dios (Cap. III). Finalmente, se recogen algunos temas que no aparecen en el preámbulo vigente (Cap. IV).This paper analyze the Preamble of the Ecuadorian Constitution, from many perspectives. It begins studying the most important functions of preambles, like those related with interpretation of the same Constitution and interpretation of other laws (Chap. I). Next, we define which subjects preambles use to consider, in Ecuador or in other constitutions, like the matter of the Constitution’s foundations and its name (Chap. II). With this base, we dedicate our efforts to study each phrase of the Preamble of the Constitution of 2008, especially those who consider the constitutional aims and God’s Name (Chap. III). At least, we consider some subjects that does not appears nowadays in our Preamble (Chap. IV).
