Descentralización y autonomía fiscal en el Ecuador: bases teóricas y tensiones jurídicas

Presenta los elementos teóricos útiles para construir los significados y alcances de los términos “descentralización” y “autonomía”, así mismo, en vía de profundización, da cuenta de un análisis jurídico crítico del desenvolvimiento y rol de estas dos situaciones, dentro de la dinámica del poder público atinente a lo fiscal y tributario en el Ecuador. También identifica tensiones surgidas entre la legislación de la materia y algunas cláusulas de la Constitución, todo a partir de la óptica del gobierno autónomo descentralizado municipal o metropolitano, por tratarse de niveles gubernativos bastante consolidados en el país.This article presents the useful theoretical elements to construct the meanings and scope of the terms “decentralization” and “autonomy”. Also, in the process of deepening, realizes a critical legal analysis of the development and role of these two situations, within the dynamic of public power pertains to fiscal and taxation in Ecuador. It also identifies tensions arising between the laws of the matter and some clauses of the Constitution, all from the perspective of the municipal or metropolitan decentralized self-government, given its consolidated gubernatorial levels in the country.
