In addition, this paper proposes that the right to freedom be read from the republican tradition, that is, as non-domination, which would help to address cases such as the present from a broader and critical view on the role of the State in the respect of fundamental rights. |

In addition, this paper proposes that the right to freedom be read from the republican tradition, that is, as non-domination, which would help to address cases such as the present from a broader and critical view on the role of the State in the respect of fundamental rights.Este trabajo analiza la sentencia No. 133-17-SEP-CC dentro de una acción extraordinaria de protección que conoció la Corte Constitucional ecuatoriana sobre la vulneración de los derechos fundamentales de una persona transexual masculina, por parte de la Dirección Nacional del Registro Civil al impedir su cambio de sexo de femenino a masculino en su inscripción de nacimiento. Para ello se divide el examen a partir de los tres problemas jurídicos que la Corte determina, relacionados con el derecho a la tutela judicial efectiva, el deber de motivación de las sentencias y el derecho a la identidad personal.
