description El Trabajo de titulación tiene como objetivo analizar la figura de negativa registral ante el silencio de la autoridad administrativa, que incluye un estudio dogmático de la doctrina administrativista referente al silencio administrativo. Las preguntas que pretendo responder son las siguientes: ¿cómo la doctrina administrativa ha desarrollado la institución jurídica del silencio administrativo? ¿cómo debe operar dentro del sistema registral ecuatoriano? ¿cuáles son los efectos jurídicos de la negativa registral? ¿cuántos tipos de negativa registral existen? ¿existen diferencias entre la negativa expresa y el silencio administrativo?. Para responder a estas preguntas se realizó un análisis del derecho ecuatoriano para mostrar los efectos de la negativa registral, cuya problemática está en la falta de celeridad en la sustanciación, y falta de motivación en el acta resolutiva de negativa que emite el Registrador de la propiedad. También realizaré un análisis de la sentencia No. 13266-2021-00067, sobre la resolución dictada por el juez sobre el proceso de causa de negativa registral, es decir un problema enmarcado en la responsabilidad del acto resolutivo que emite el registrador de la propiedad.

The questions that I intend to answer will be: how has the administrative doctrine developed the legal institution of administrative silence? How should it operate within the Ecuadorian registry system? What are the legal effects of refusal to register? How many types of registration refusal are there? Are there differences between express refusal and administrative silence? To answer these questions, an analysis of Ecuadorian law was carried out to show the effects of the registration refusal, whose problem is the lack of speed in the substantiation, and lack of motivation, in the refusal act issued by the Property Registrar.
