With the growth of the industrial and society development, technology became one of the most important and essential tools, which was a privilege for a few people and the desire of all the population at its beginnings. Undoubtedly, technology has become an essential role in the economy, for this reason, a need to regulate this instrument through the use of intellectual property and penal branches for the misuses was the best option, and depending of the impact of the damages caused the Antitrust Law is used. This work tries to analyze the illegal actions of informatics, its origins and effects in the Antitrust Law in EcuadorEl Derecho de la Competencia es una rama del Derecho que a pesar de su importancia y trascendencia económica, apareció dentro de nuestro país a principios del año 2008. Es por esta razón, que las normas y cultura de Libre Competencia hasta el momento no han llegado a ser analizadas a profundidad, y relacionadas con demás ramas del Derecho, en especial con las nuevas ramas y derechos que han surgido como efecto de la globalización y los nuevos factores de producción. Con el desarrollo industrial de la sociedad, y con la noción de una sociedad inteligente surgió un factor decisivo que revolucionaría todos los paradigmas sociales, este factor es la tecnología; la cual, en sus inicios era un privilegio de pocos y el deseo de muchos. Sin embargo, su eficiencia, desarrollo e innovación convirtió a la tecnología en un factor de producción más, por lo cual se vio la necesidad de proteger y sancionar los usos antijurídicos del mismo, a través del Derecho de Propiedad Intelectual y Derecho Penal; y, dependiendo su impacto en los mercados relevantes, desde poco tiempo atrás, se lo ha analizado a la luz del Derecho de la Competencia.
