| Summary: | The purpose of the current investigation is to demonstrate what extent the principle of temporality was effective and respected in the control of constitutionality of the states of exception issued to Petroecuador and its subsidiaries. The period in which these states of exception were created began from November 2008 until September 2009. For the purposes of this essay, a review will be carried out on the doctrine and legal norms regarding the control of constitutionality applied to states of emergency in Ecuador. Likewise, it will proceed to analyze the executive decrees and their respective opinions issued by the Constitutional Court of Ecuador for the transition period. Finally, a claim of unconstitutionality filed against the states of emergency issued by the executive toward Petroecuador and its subsidiaries will be examined to determine the effectiveness of the constitutionality control, identifying the temporal limits applied to these states of exception, since, according to Records, these decrees were issued repeatedly disrespecting the principle of temporality. |
