Резюме:In Ecuador, the elderly is a group of priority, as stipulated in the Constitution, governing standard of our legal system. Generally, the eldery has degenerative problems associated with their central nervous system. So, we decided to study two types of diseases given its reversibility. The sensitivity of the receptors, memory and perception are affected when developing a mild cognitive impairment and later may progress to become a Disease of Alzheime. As Mild Cognitive Impairment is still a concept in development, clear limitations have not been given about the capacity to perform some acts in law. So, we wanted to clarify this point with the following study. This study analyzes the implications of these kinds of diseases on the legal capacity of the elderly. What are the bases for the elderly to perform acts and contracts without a guardian to manage their property and act for themselves, and finally, when capacity should be limited by a ban. With both scientific and legal research, we have given an answer to the problem of legal capacity associated to the ban of the elderly, to determine the moments in which a person is unable for law, when their acts are valid and when they are not.
