In a first space must be observed and analyzed the importance of the will and consent as marrows of the formation of the legal business, because although it is true, only legal effects will occur if there is the intervention of human will and consent for the conformation of the legal business. Then the simulation, its structure and its classes are included in order to specify the effects that it will have and how it causes damage. Finally, an analysis is obtained of the effects of the simulation on the parties of the legal business or third parties not involved in it, the importance of its legality or illegality and the approach to the nullity or inexistence of the business itself by effect of the simulation. |

Finally, an analysis is obtained of the effects of the simulation on the parties of the legal business or third parties not involved in it, the importance of its legality or illegality and the approach to the nullity or inexistence of the business itself by effect of the simulation.La simulación ha conllevado a desarrollar diferentes acepciones de este amplio tema que en el diario vivir del ser humano se manifiesta como una latente práctica, la misma que conlleva los efectos que este acto llegare a producir sobre las partes intervinientes o terceros poseedores de derechos sobre el objeto del negocio jurídico. En un primer espacio se debe observar y analizar la importancia de la voluntad y el consentimiento como médulas de la formación del negocio jurídico, pues si bien es cierto, solo se producirá efectos legales si existe la intervención de la voluntad humana y su consentimiento para la conformación del negocio jurídico. Luego se abarca la simulación, su estructura y sus clases a fin de precisar los efectos que tendrá y como causa un perjuicio.
