Sammanfattning:This academic essay develops the legal problem of prior constitutional control of international treaties that do not require legislative approval in Ecuadorian law. The Ecuadorian constitution distinguishes the treaties that need legislative approval, numbered in article 419, from those that do not require legislative approval. The international instruments that require legislative approval are favored with previous binding constitutional control while those that do not require legislative approval do not have this constitutional control. The previous binding constitutionality ruling of international treaties is the suitable tool in order for the pacta sunt servanda and constitutional supremacy principles to be protected and guaranteed. A complete constitutional control will also contribute to serious and sensible foreign policy.
