Ամփոփում:The purpose of this research entitled AMENDMENTS TO THE CURRENT REGULATIONS OF THE COMPULSORY INSURANCE OF TRAFFIC ACCIDENTS APPLIED TO THE ECUADORIAN REALITY is to analyze the provisions governing the SOAT and its application in the process of claim of compensation. This analysis is not only critical, but also proposes alternatives to this assurance system in order not to be affected in an unprincipled manner. Information regarding this assurance system has been collected in several countries of the region. This information has allowed us to make the corresponding comparisons with our own. In addition, an analysis of decisions issued by the Superintendence of Banks and Insurance is carried out. This analysis is focused on how to pay compensation in the participation of two or more vehicles in front of three others not transported. Furthermore, the existing flaws of the Ecuadorian SOAT system have been exposed along with practical solutions. This labor has been accomplished with the settled goals. It has enable us to make reform proposals regarding the definition of traffic accidents, conceptualization and determination of the coverage of medical expenses, total and permanent incapability, compensation for death, funeral expenses, and transportation costs. Moreover, the principles to analyze traffic accidents have been delimited. Additionally, new exclusions to coverage, a mechanism of notification of claims, and a reduction in the percentages of charge have been established with the aim to strengthen this system in order to benefit people who unfortunately may have a traffic accident. Finally, this dissertation would serve as a benchmark for specialization in insurance. Due to the fact that the SOAT system practically is new in Ecuador, it must be considered to be modernized and evolve.
