| description | The purpose of this research entitled AMENDMENTS TO THE CURRENT REGULATIONS OF THE COMPULSORY INSURANCE OF TRAFFIC ACCIDENTS APPLIED TO THE ECUADORIAN REALITY is to analyze the provisions governing the SOAT and its application in the process of claim of compensation. This analysis is not only critical, but also proposes alternatives to this assurance system in order not to be affected in an unprincipled manner. Information regarding this assurance system has been collected in several countries of the region. This information has allowed us to make the corresponding comparisons with our own. In addition, an analysis of decisions issued by the Superintendence of Banks and Insurance is carried out. This analysis is focused on how to pay compensation in the participation of two or more vehicles in front of three others not transported. Furthermore, the existing flaws of the Ecuadorian SOAT system have been exposed along with practical solutions. This labor has been accomplished with the settled goals. It has enable us to make reform proposals regarding the definition of traffic accidents, conceptualization and determination of the coverage of medical expenses, total and permanent incapability, compensation for death, funeral expenses, and transportation costs. Moreover, the principles to analyze traffic accidents have been delimited. Additionally, new exclusions to coverage, a mechanism of notification of claims, and a reduction in the percentages of charge have been established with the aim to strengthen this system in order to benefit people who unfortunately may have a traffic accident. Finally, this dissertation would serve as a benchmark for specialization in insurance. Due to the fact that the SOAT system practically is new in Ecuador, it must be considered to be modernized and evolve. |

Due to the fact that the SOAT system practically is new in Ecuador, it must be considered to be modernized and evolve.El presente trabajo de investigación titulado “Reformas a la Normativa vigente del Seguro Obligatorio de Accidentes de Tránsito, aplicadas a la realidad ecuatoriana”, tiene como finalidad el de analizar las disposiciones que rigen al SOAT y su aplicación en el proceso de reclamación de las indemnizaciones, un análisis que no solamente es crítico, sino que propone alternativas para que este sistema se aseguramiento no resulte afectado o no sea aprovechado de manera inescrupulosa. Se ha recopilado información respecto a este sistema de aseguramiento en otros países de la región, permitiendo realizar las correspondientes comparaciones con el nuestro. También realizamos un análisis de resoluciones emitidas por la superintendencia de Bancos y Seguros respecto a cómo se debe pagar una indemnización en la participación de dos o más vehículos frente a terceros no transportados, de la misma manera, se ha expuesto las falencias existentes en el sistema SOAT ecuatoriano, planteando soluciones prácticas. Este trabajo ha cumplido con los objetivos planteados, permitiendo realizar propuestas de reforma en lo que respecta a la definición de accidente de tránsito, conceptualización y determinación de las coberturas de gastos médicos, incapacidad total y permanente, indemnización por muerte, gastos funerarios y gastos de transporte, también delimitamos los principios en base a que se deben analizar los accidentes de tránsito, establecimos nuevas exclusiones a las coberturas, un mecanismo de notificación de reclamos, reducción de los porcentajes d recargo, todo esto con la finalidad de que este sistema se fortalezca y continúe beneficiando a las personas que desafortunadamente sufren un accidente de tránsito, además de que este trabajo de investigación sirva como referente de especialización en seguros, por cuanto el SOAT es un sistema prácticamente nuevo en el Ecuador, el mismo que debe evolucionar y tecnificarse.Quito: Universidad de las Américas, 2013Torrontegui Martínez, Miren Josune2015-05-13T21:45:17Z2015-05-13T21:45:17Z2013info:eu-repo/semantics/publishedVersioninfo:eu-repo/semantics/bachelorThesis175 p.application/pdfCastillo Gutiérrez, M.
