Shrnutí:The protective custody is the restriction of people freedom, one of the main rights of men, which is recognized and guaranteed by the state in the Art. 66, number 29, paragraph a., of the political Constitution of the republic of Ecuador. A person who suffers protective custody is considered as an unhelpful and as a negative element of the society. Furthermore, the protective custody has been used as a deliberate way and as a mechanism to slow down the violence of our country in order to guarantee harmony and public safety. If the protective custody were used as a freedom restriction and as a precautionary measure, there were not many jails full of people that have committed a criminal offense and in some cases people who have not committed any kind of offence and are in jail. Our country has signed and ratified the American convention of the human rights that establish the personal right to the freedom. However, it has not been guaranteed in an effectively way and has been suspended for arbitrary detentions.
