| Sumari: | Throughout history, music has been conceptualized by different thinkers in many different ways. Even as early as Platon, music has been linked with judiciary concepts. He proposes a real link between law and music. In fact, such is the importance of music to jurisprudence, that countries like Switzerland have incorporated musical education as an article of their constitution. As a consequence, this paper recommends, the incorporation of an amendment to the Ecuadorian constitution, guaranteeing basic musical education as an obligation of the Sate. In order to support said claim, this paper begins by determining which individual and collective rights are exercised while engaging in musical activities, while analyzing the function the State has in said activities. It then establishes the state of musical education in Ecuador as derived by the right to social education. Thirdly, it concludes that, to protect the practice of music, is to protect various constitutional rights, and as a consequence, it is not judicially disproportionate to elevate this proposal to a constitutional level. Finally, it delves in the constitutional mechanisms present in the 2008 constitution, concluding that the more adequate of which would be the constitutional amendment, by referendum. |
