Riassunto:The present thesis seeks to study the field of Competition Law in Ecuador, its early advances in the subject and the reality faced by economic agents that form part of the market. The General Objective of this work is to study the legal-economic conditions of competition in Ecuador and to propose the mechanisms of action that the State has to observe the market, starting from Ecuadorian factual premises. Drafting by sector the relationships among the State (as regulatory entity) and the economic agents is among the specific objectives, in order to propose a legal framework based on principles that tend to the subsequent elaboration of a competence control system, specifying classifications, competences, and general features that contribute to a successive legal proposal. The research method used is the hypothetical-deductive one, given that a hypothesis has been proposed as a result of the assembly of empirical data, principles, laws and other more general, acquired during the university career and the preliminary investigation. Private cases by industry are also analyzed to find legal concepts to handle in the research, and once they are known, to work in a final proposal, that gathers all those concepts previously analyzed. The conclusions look for achieving an adequate proposal, consistent with the Ecuadorian market reality, including an institutional offer that details competences, regulation tools and procedures.
