However, it is necessary to highlight how the best interest of the child affects the development of Basic Education teachers, since they have lost authority within educational establishments, thus limiting the power to implement discipline, as well as comply with what the chair requires for an excellent academic training process, in such a way that the teacher can dictate mandatory activities and order that they be fully carried out without having to reach situations of disrespect, causing verbal discussions, or much worse, causing physical aggression between the teacher and the student due to a situation of disobedience, arrogance and disrespect of the academic subjects. For the present investigation a qualitative approach has been selected, because a legal investigation is going to be carried out and therefore this qualitative investigation will allow us to collect, analyze and interpret all that information that is relevant for the development and support of the topic. proposed. However, the research will also have a quantitative approach, because through it we will achieve the collection of numerical data for later analysis. The techniques that will be used are the interview and the survey; and because it is an investigation in the area of law, the analysis of documents will also be used. I finish by 5 analyzing the data obtained compared with the theory and the law to close the investigation with conclusions and recommendations. Keywords: Rights, Guarantees, Principles, Best Interests of the Child and Adolescent, legality, equity.La importancia del presente proyecto de investigación titulado “Los derechos y garantías de los maestros frente al interés superior del niño, niña y adolescente” está enfocada en realizar un análisis jurídico de los derechos y garantías de los maestros de Educación Básica frente al principio del interés superior del niño, niña y adolescente. Además de ello, establecer el ordenamiento jurídico de los derechos y garantías de los maestros, así como también la normativa jurídica relacionada al interés superior del niño, niña y adolescente en el Ecuador. Empero, es menester resaltar como el interés superior del niño afecta al desenvolvimiento de los maestros de Educación Básica, ya que han perdido autoridad dentro de los establecimientos de educación, limitándose así a no poder implantar disciplina y exigir que se cumpla a cabalidad con todo lo que la cátedra requiere para un excelente proceso de formación académica, de tal manera que el docente pueda dictar actividades con carácter obligatorio y ordenar que las mismas sean realizadas a cabalidad sin tener que llegar a situaciones de irrespeto, provocando discusiones verbales, o mucho peor, suscitarse agresiones físicas entre docente y estudiante por una situación de desobediencia, prepotencia e irrespeto de los dirigidos académicos. Para la presente investigación se ha seleccionado un enfoque cualitativo, debido a que se va a llevar a cabo una investigación jurídica y por lo tanto esta investigación cualitativa nos permitirá recopilar, analizar e interpretar toda aquella información que sea relevante para el desarrollo y sustento del tema planteado. Más, sin embargo, la investigación tendrá también un enfoque cuantitativo, debido a que a través de la misma alcanzaremos la recolección de datos numéricos para su posterior análisis. Las técnicas que se van a usar son la entrevista y la encuesta; y por ser una investigación en el área de derecho se utilizará también el análisis de documentos. Finalizaré el presente trabajo investigativo analizando la información y los datos obtenidos comparando con la teoría y la ley para cerrar la investigación con conclusiones y recomendaciones.
