Тойм:The swindle is presented worldwide as one of the crimes whose incidence in the legal field has grown in recent years, developing it under new and modern modalities that seek to damage the patrimony of persons, where the participation of the intended victim, as a result of deception, has made available its assets. In this sense, the objective of this research is to analyze legally and doctrinally the responsibility of the victim in the crime of swindling, especially when the object offered may be illicit. For this purpose and through an inductive, deductive and systemic methodology, under a qualitative, descriptive and correlational approach and using techniques such as the interview and a case study, it has allowed to identify basic characteristics of the problem under study, defining elements, profiles and behaviors of the crime of swindling, the latter where emphasis is made on the role of the victim and his active participation at the moment of the detachment of his patrimony, when he is fully aware that the object of the swindle is illicit. All this has led to important conclusions, fundamentally, in the existence of legal loopholes or permissiveness of the law by the deficient typification of the crime, has allowed to generate subjective analysis by operators of justice that, assuming ineffective positions, through their decisions, can violate principles that the victim deserves through a state criminal protection Key words: Fraud, victim participation, unlawful object and state protection
