The application of the principle of minimum criminal intervention as a solution to the crisis facing the prison system in Ecuador had the objective of carrying out a legal analysis on the applicability of the principle of minimum criminal intervention in the Comprehensive Criminal Organic Code and its effects on the prison system. For the application of the present study, a descriptive and explanatory investigation was approached through the historical - logical, inductive and analytical - investigative methods, with a non-experimental design. The primary sources of information were through interviews with justice administrators and the secondary sources of information with a bibliographic check. The data collected was analyzed and interpreted through the technique of discourse analysis, where it was noted that the minimum criminal intervention is last resort and all the necessary principles or alternative methods must always be exhausted to solve the problem. conflict as referred to in article 190 of the Constitution of the Republic of Ecuador. Finally, it allowed us to conclude that the prison issue has a dire state in our country, it is essential that public policies be implemented in order to improve the situation of prisoners, prison guides and all components of this sector.
