Gaia:The Tagaeri and Taromenane indigenous peoples, located in the Ecuadorian Amazon, have been recognized as peoples in voluntary isolation (PIAV), which grants them special rights by virtue of their decision to stay out of contact with the majority society. Their fundamental rights include collective ownership of their territories, free determination of their way of life and equality before the State. However, these rights have been repeatedly violated The Inter-American Court of Human Rights has determined that the Ecuadorian State is responsible for the violation of several rights of these peoples, despite the existence of measures such as the creation of the Tagaeri Taromenane Intangible Zone (ZITT), which has proven to be insufficient in practice. The persistence of activities such as oil exploitation and illegal logging in the Yasuní National Park has put its physical, cultural and spiritual integrity at risk, evidencing a weak application of the precautionary principle by the State This study analyzes, from a legal and social perspective, the main challenges faced by the Tagaeri and Taromenane peoples in defending their rights, especially in the face of the advance of extractive projects. It is concluded that the guarantee of their rights requires effective, sustained and culturally appropriate state actions that respect their selfdetermination and ensure their survival in conditions of dignity KEYWORDS: collective property, self-determination, equality, indigenous peoples, human rights.
