Özet:Paternity challenge in Ecuador refers to the legal process through which a person can request the annulment of another person's parentage, for the reasons established in legal regulations. The reason for challenging paternity, in general, is the absence of filiation between father and child. To challenge paternity, a complaint must be filed before the judicial administration body, which must include proof that the father listed on the birth certificate is not the biological father. The only proof admitted in our legislation, regarding the absence of filiation, is the DNA test. Voluntary recognition is the act through which a person freely declares that a minor is his or her child before the competent authority and in accordance with the standard established in the Civil Code. Voluntary recognition does not require any type of proof that there is a biological link between the recognizer and the recognizer. Currently, the Civil Code determines that, once the child is voluntarily recognized, this recognition is unchallengeable, when it is alleged that the reason for the challenge is the absence of a legal link between father and child.
