The Social Rehabilitation System in our country is in charge of the full rehabilitation of persons previously processed and with a criminal sentence to reinsert them into society, as well as the protection of persons deprived of liberty and the guarantee of their rights; in short, the purpose of this system is to house, recover, vindicate and restitute persons deprived of liberty, who are nothing more than citizens who have broken the law by committing crimes. In recent years the social rehabilitation system has been clouded by several riots, which have involved acts of vandalism and barbarism inside the country's prisons. This in itself has caused an increase in citizen security and the growth of criminal gangs inside the prisons to control the illegal and illicit trade of narcotic and psychotropic substances both inside and outside the prisons, as well as extorting the owners of small and large enterprises (Vaccines), robberies and assassinations. This research is of an explanatory and qualitative-quantitative nature, as well as the deductive, statistical, descriptive and historical method was implemented, in addition, the use of surveys and interviews with people deprived of liberty with good conduct and administrative staff will be carried out. Key words: criminal law, violation of rights, social rehabilitation system, riots, rights of persons deprived of liberty.El presente trabajo investigativo pretende dar desde una visión general si, las posibles causas de las problemáticas en el centro de privación de libertad de Esmeraldas son convexas a las falencias que tiene la política pública criminal en cuanto a la protección de los derechos de las personas privadas de libertad, a más de dejar un precedente para optimizar la ejecución de la administración carcelaria, a modo de propuesta. El Sistema de Rehabilitación Social en nuestro país, es el encargado rehabilitar de forma íntegra a las personas previamente procesadas y con una sentencia penal para reinsertarse en la sociedad, así como la protección de las personas privadas de libertad y la garantía de sus derechos; en pocas palabras la finalidad de este sistema es el de alojar, recuperar, reivindicar y restituir a las Personas Privadas de Libertad, quienes no son más que ciudadanos que han incumplido las leyes llegando al cometimiento de delitos. En los últimos años el sistema de rehabilitación social se ha nublado por varios amotinamientos, en los cuales se han visto inmiscuidos actos de vandalismo y barbarie dentro de los centros penitenciarios del país. Esto en sí mismo ha provocado el investimento de la seguridad ciudadana y el incremento de bandas criminales dentro de las cárceles para controlar el comercio ilegal e ilícito de sustancias estupefacientes y psicotrópicas tanto dentro como fuera de ellas, a más de, extorsionar a las personas propietarias de pequeños y grandes emprendimientos (Vacunas), robos y sicaritos. 9 Esta investigación es de índole explicativa y cualicuantitativa, como también se implementó el método deductivo, estadístico, descriptivo e histórico, además, se efectuará el uso de encuestas y entrevistas a las personas privadas de libertad con buena conducta y al personal administrativo.Universidad Estatal de Bolívar.
