| Resumo: | The research topic: "The food obligation of the alleged father in the face of the negative result of the DNA test, in the canton of San Miguel, year 2022" It focuses on analyzing the right to food of the pregnant and breastfeeding woman, specifying that, the man that the woman indicates as the father must pay the pension; once the child is born, the procedure should be to establish paternity, for the following reasons: identity of the minor, rights and obligations of the father, food for the minor. However, if the mother does not take the child to take the DNA test, even though it can already be performed and determine whether or not the paternity of the defendant exists, the mother may decide not to take the child, and the defendant must continue to pay the child support for the pregnant and breastfeeding woman, for a total of 21 months, 9 months of gestation and 12 months of breastfeeding. If the paternity of the defendant is established, in addition to the right of maintenance of the pregnant and breastfeeding woman, it would be possible to demand the maintenance of the minor, which would guarantee his integrity; therefore, the failure to do so when the mother opposes the DNA test, violates the rights of the child. If the non-paternity of the maintenance defendant is established, it is clear that his rights would have been violated, as is the case of honor, as well as the rights of his own children, because the defendant's family would have been forced to support a child who does not belong to the family group, limiting the economic possibilities of the household. Methodology: The research adopts a qualitative approach and is descriptive in scope. The main approach is interpretative, both literal and systematic to cover all aspects of the central theme. The research is of the literature and documentary review type, without having an experimental design. Surveys will be used to validate the research, considering the opinion of experts. The research technique used was the survey through a questionnaire. At the end of the work, the main conclusions and recommendations were reached.
