The International Labor Organization (ILO) has stated that the increase of unemployed people in Latin America and the Caribbean amounts to 41'000,000, which is a historical figure and what is worse, the organization has also determined that in the coming years it could rise 4 percentage points, all this has forced people to accept jobs such as in nightclubs, accepting very low wages for the activity they perform. Due to the current economic crisis derived from the long world pandemic due to COVID and the enormous number of migration mainly by Venezuelan citizens, in Ecuador there has been an increase in the available labor force, which has caused an increase in the hiring of informal workers. Considering that the acceptance of employment implies a waiver of labor rights, this group includes discotheque workers, who work in inadequate conditions. Turning to remuneration, it should be noted that it should not be less than that established by the Unified Basic Wage, which corresponds to $425.00. The payment of a remuneration lower than that stipulated by law demonstrates an exploitation of the unemployment circumstance and the violation of the rights of the worker, who accepts such conditions out of necessity. Likewise, discotheque workers do not have the payment of legal benefits, such as the thirteenth and fourth salary. They do not receive overtime pay, nor are they affiliated to the IESS. The objective of this research was to learn about the labor situation and the various labor violations suffered by discotheque workers, as well as the domestic law regulations that provide for the treatment of such violations, given that all workers are protected by the laws 18 of our country. The research approach will be quantitative and qualitative, with a descriptive, bibliographic-documentary type scope, the method used was the analytical one, which allowed to legally establish the possible affectations and violations to the labor rights of discotheque workers in the city, through the use of surveys as data collection techniques.
