Eficacia de los mecanismos de reparación integral en delitos de violencia sexual en el cantón San Miguel 2020.

In the present research work, a fundamental topic is addressed that practically continues to be a task to be fulfilled, the integral reparation to the victims of criminal offenses in order to compensate the damages caused by the illegal act as far as possible. In this way, the research problem is The Crimes of Sexual Violence and the Comprehensive Reparation of the Victim. Thus, the general objective of the research is to analyze the current mechanisms of comprehensive reparation in crimes of sexual violence to determine shortcomings in the criminal procedure system. In this sense, the research question is: the comprehensive reparation mechanisms affect crimes of sexual violence in the Canton of San Miguel, Bolívar province in the year 2020, since the State does not guarantee an adequate comprehensive reparation to the victims, especially to the boys, girls and adolescents. The methodology used to carry out the study in the field is descriptive and in the applied, descriptive and exploratory type, as methods the inductive, hypothetical deductive, legal, scientific, legal hermetic were used. For data collection, the survey was used to a population of 65 among lawyers in free practice, servers of the Prosecutor's Office and the Judicial Unit. In the result, it can be seen that the vast majority indicate that the justice operators limit themselves to applying the comprehensive reparation mechanisms only to the pecuniary part, neglecting important aspects that contemplate comprehensive reparation, such as the psychological rehabilitation of the victims among others. Concluding, the State must guarantee the rights of the people attacked, in crimes of sexual violence, comprehensive reparation is a right of victims of violation of rights of any nature, but it has a special connotation in the field of criminal law.
