| Tóm tắt: | Through this research work, titled "LEGAL MECHANISM TO ESTABLISH MINIMUM SUPPORT PRICES FOR AGRICULTURAL PRODUCTS IN THE ECUADORIAN HIGHLANDS," I will conduct a legal analysis of the mechanisms employed by the Ecuadorian government, through relevant public institutions, to determine minimum prices for agricultural products. This analysis will consider the perspective of both small and large-scale producers, as the agricultural economy and production depend significantly on these established minimum prices. Agriculture plays a pivotal role in the economy of Ecuador, particularly in the highlands region, where climatic and geographical conditions favor the production of various agricultural products. However, farmers often encounter significant economic challenges, price fluctuations, and adverse weather conditions that impact their livelihoods and the stability of the sector. In this context, the implementation of a legal mechanism to establish minimum support prices is proposed as a necessary strategy to enhance the economic security of farmers in the Ecuadorian highlands. The Ecuadorian highlands host a variety of essential crops, such as corn, potatoes, wheat, barley, and quinoa, among others. These agricultural products are not only crucial for the country's food security but also constitute a significant portion of income for farmers in the region. However, the absence of an effective mechanism to establish minimum prices has left these farmers susceptible to market fluctuations, directly impacting their ability to sustain their operations in a financially viable manner. It is important to conduct an analysis of the legal framework underpinning the Ecuadorian state's authority to impose minimum prices on agricultural products from the highlands. It is also important to note that these products incur lower costs compared to 6 those produced in the coastal regions, leading to economic instability for highland producers. Conducting a comparative and analytical investigation aimed at elucidating various legal and procedural aspects associated with the imposition of minimum costs on products will enable us to gather valuable information for proposing and structuring latent regulatory needs. This is crucial for safeguarding the interests of highlands farmers. The research methodology employed is qualitative, utilizing the dogmatic and interpretative method of constitutional and legal norms. Through these methods, a response to the addressed problem is provided based on the best possible reconstruction permitted by the legal material available. Additionally, since the social facts or phenomena studied in this work are measurable and quantifiable, I will measure and establish causal relationships between variables to explain the study problem and the current social reality.
