El Sistema Nacional de Rehabilitación Social frente a la crisis carcelaria en el Centro de Privación de Libertad del cantón Guaranda en el año 2021.

This Research Project has the purpose of carrying out a study of the National Social Rehabilitation System, its structure, the purposes of the social rehabilitation of persons deprived of liberty, what is the planning for their social reintegration and, clearly establishing what are the rights of persons deprived of liberty; all this within the context of the prison crisis that took place throughout the country in 2021; but above all an analysis carried out punctually in the Guaranda Canton Rehabilitation Center. Carrying out a complete study of what is done in the Social Rehabilitation centers to eradicate the harsh penitentiary reality that Ecuador has experienced for several years, has shown us the lack of concern and poor organization of the State and the penitentiary authorities in managing an adequate Penal System; for this I will focus my study on the Center for Social Rehabilitation of Guaranda Canton, Province of Bolívar, which has also suffered the effects of this serious prison crisis; even being one of the smallest centers in the country, it has also been affected by the prison crisis and its repercussions, because several dangerous inmates were even transferred to this center from Guayaquil. During the year 2021, in the Ecuadorian state there was a serious prison crisis due to the massacres that took place inside several rehabilitation centers in the country where the most bloody deaths were experienced, videos of the aforementioned massacres and attacks were published massively, never before seen in our country, which also revealed the lack of efficiency and the lack of administration in the National Social Rehabilitation System, as a result of which facilities were destroyed, walls were torn down, hundreds of deaths in the most violent manner, the management of extortion was evidenced, as well as the subhuman conditions in which most of the Persons Deprived of Liberty live; which caused a social alarm that made the insecurity indexes transparent and how large criminal mafias are managed from the centers of deprivation of liberty inside and outside them. 6 Due to the aforementioned and by spreading this to all the rehabilitation centers of the Ecuadorian State, it is necessary to carry out an investigation in one of the smallest social rehabilitation centers such as the one in Guaranda Canton, in order to have an idea of how the system works legally; what is causing the prison crisis and what are the measures that have been taken to ensure social reintegration and respect for the rights of persons deprived of their liberty, but above all, after making an analysis of the legal regulations and the doctrine, propose some suggestions from the academy, supported by a field study that allowed me to obtain clearer results. The research methodology is of a qualitative type, with the dogmatic and interpretive method of the constitutional and legal norm, since through these methods an answer to the problem treated is offered based on what produces the best possible reconstruction allowed by the material law that is available. In addition, since the facts or social phenomena studied in this work are measurable and quantifiable, I will measure and establish causal relationships between the variables, to explain the study problem and the current social reality.
