El derecho penitenciario y la aplicación del sistema garantista en el Ecuador

Analyzing the characteristics of penitentiary law and the application of the guarantee system, to improve the management and responsibilities of the penitentiary system was the objective of the investigation, due to the events presented in the deprivation of liberty centers in Ecuador. The applied methodology started from a mixed approach, for the purpose it opted for the use of applied research. Due to the level of investigation, descriptive and exploratory investigations were considered, the subjects of the investigation were those deprived of liberty of the Deprivation Center of the city of Guaranda; observation and the survey technique were used for data collection. From the analysis of the data, the following results were reached: the highest concentration regarding age is between 18 to 65 years, the largest number of people the substantiation of crimes for which they are deprived of liberty are in process; In relation to ethnicity, the majority self-determine mestizos, in relation to the violation of fundamental rights they consider that it is at the level of justice operators; the non-observance of rights, those deprived of liberty state that they do not have access to legal representation, receive mistreatment, punishment and restrictions due to retaliation due to their complaints; as well as that in the center it allows inadequate health care, sanitation and hygiene; that the conditions of the infrastructure of the center are inadequate, they do not provide the conditions to serve people with special needs, added to the need for training of the guide staff.
