Zusammenfassung:This research paper addresses the legal duality in labor matters in Ecuador, specifically analyzing the regulatory differences between the public sector, governed by the Organic Law of Public Service (LOSEP), and the private sector, regulated by the Labor Code. The research seeks to determine how this duality affects compliance with the constitutional principle of equality established in Article 11, paragraph 2, of the Ecuadorian Constitution, as well as its socioeconomic implications. The issue centers on the marked differences that generate labor inequalities. On the one hand, public sector workers enjoy greater job stability based on a merit-based and competitive system, wages regulated by career ladders, and access to additional benefits such as employer-sponsored retirement and broader leave. In contrast, private sector workers face reduced job stability due to factors such as unfair dismissal, less regulated wages, and limited social security coverage.
