Résumé:Human mobility is one of the phenomena that has hit Latin America, for several decades, either for reasons of migration or displacement, many people have seen the need to leave their country of origin in search of new and better job opportunities, in recent years Ecuador has become the destination of many foreigners since there are minimum entry requirements to the country, and being a guarantor and ratifying state of different international treaties and conventions in favor of human rights, work is recognized as one of the fundamental rights that the human being possesses to survive, improve his quality of life and to ensure the standards of dignity contemplated in the Constitution of the Republic of Ecuador. In this sense, migration and labor law are deeply related, the Ecuadorian state has designed migration policies to regulate the movement of migrants who are in a dependency, national and international instruments seek to guarantee equal opportunities between national and foreign citizens, so that effective access to work is given, with these a fair remuneration is sought by an employer or employer, without distinction. The labor rights of migrants, as well as for the sending, receiving and transit country have been of great interest, that is why equality between Ecuadorians and foreigners has been reflected in Ecuadorian legal regulations, regulations have been created for their entry, also for their labor insertion, but that happens when an undocumented migrant is working under dependence and their labor rights are violated that guarantees several legal norms. Within the development of this research project, the objective is to carry out a legal analysis of the situation involving the undocumented migrant within the city of Ambato and the violation of their labor rights. The undocumented status has allowed fundamental rights, such as the right to work, to be ignored by some employers or employers, who through labor exploitation maintain their economy. as they benefit from low foreign labour costs, long working hours and no access to social security. Through the methodology proposed in the research work, it is intended to demonstrate whether public migration policies aimed at labor rights are violated.
